Agreement Terms

Authority. I represent that I am the minor's parent or legal guardian and have authority to provide the permissions and acknowledgments contained in this agreement.

Permission to Participate. I voluntarily give permission for the identified minor to participate in the Charleston Sunsets Sailing charter and authorized activities.

Acknowledgment of Risks. I understand recreational sailing and boating involve inherent and other risks including vessel movement, slips/falls, rigging, waves, wakes, weather, currents, collision, boarding/disembarking, authorized swimming, drowning, equipment-related injury, and delayed emergency medical assistance. These risks may result in serious injury or, in extreme circumstances, death.

Safety Requirements. The minor will follow all captain/crew instructions. The minor must wear an appropriate PFD whenever required by law or directed by the captain. The captain may require the minor to wear a PFD throughout the entire charter regardless of swimming ability.

Supervision. I understand captain and crew operate the vessel and are not childcare providers. I accept responsibility for appropriately supervising the minor. The minor may not enter the water without express captain permission and required adult supervision.

Assumption of Risk. On behalf of myself, I acknowledge the inherent risks associated with allowing the minor to participate and voluntarily accept those risks to the extent permitted by applicable law.

Release. To the fullest extent permitted by applicable law, I agree to release provisions applicable to my own claims arising from the minor's participation. Nothing in this agreement is intended to waive or release any claim belonging to a minor where such waiver/release is prohibited or unenforceable under applicable law.

Emergency Medical Authorization. I agree to inform the captain of information materially relevant to the minor's safe participation and emergency treatment. If I am unavailable or unable to consent during an emergency, I authorize the captain/crew to contact emergency services and facilitate reasonably necessary emergency care.
